I. INTRODUCTION

This document is a privacy policy (policy) of Deeplai P.S.A. with headquarters in Lublin (20-445 Poland), ul. Zemborzycka 72, exposed into Polish company register maintained by the District Court for Lublin-Wschód in Lublin with office in Świdnik (VI Commercial Department of the Court Register) under number 0000918587, using the VAT-ID 9462691664. The share capital of the Company is 5 334 800,00 PLN, hereinafter called a Deeplai.

The Deeplai's policy in a general way explains the rules of processing and sharing personal data of Deeplai's websites users which are operating at internet addresses:

By accessing any of the aforementioned websites or by sending to Deeplai any personal data through them, data will be processed in accordance with the policy. These websites are used to promote and sell the Deeplai solutions only to entrepreneurs.

The policy also contains information on how we use the so-called cookies and other technologies that allow to storage information about websites on end-user's devices. The privacy policy is constantly updating - in line with the changes resulting from the technology used on the Deeplai's websites.

II. PERSONAL DATA CONTROLLER

WHO CAN I CONTACT IN MATTERS REGARDING THE PROTECTION OF PERSONAL DATA?

WHAT IS THE PURPOSE OF PROCESSING MY PERSONAL DATA?

Deeplai process your personal data for the following purposes, alongside which are given the legal grounds for processing: in purpose to answer a question or other message sent by the user - according to the GDPR, we assume that if you decide to send a message by the contact form or e-mail and if you are providing your personal data, the controller is authorized to process your data - legal basis is art. 6.1.a of GDPR; fulfilling the controller's legitimate interest which rely on conducting analytical and statistical activities that regard users' activity, as well as their preferences in purpose to improve the functionalities and services provided - legal basis is art. 6.1.f of GDPR.

WHO WILL BE THE RECIPIENT OF MY PERSONAL DATA?

Your personal data will be disclosed by the controller to cooperating entities (recipients). The disclosure of your data is always based on a data processing agreement, which is a fully compliant practice with the GDPR. The entities to which Deeplai discloses your personal data will be:

1. OVH Polska sp. z o. o. - IT infrastructure and services provider that maintains individual websites and services used by Deeplai.

2. Google LLC (California, United States of America) - IT infrastructure and services provider used by Deeplai, including Google Analytics service provider that allows us to conduct analytical and statistical activities.

3. Amazon Web Services Inc. (California, United States of America) - IT infrastructure and services provider used by Deeplai.

4. Apple Inc. (California, United States of America)

5. Google LLC – Google reCAPTCHA (California, United States of America) – provider of the reCAPTCHA v3 bot-protection service used on the contact form of this website.

To protect our contact form against automated abuse and spam, we use Google reCAPTCHA v3, a service provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. reCAPTCHA v3 operates entirely in the background – it does not display a CAPTCHA puzzle or require any user interaction. Instead, it analyses behavioural signals (such as mouse movement, browsing patterns, and interaction with the page) and assigns a risk score to each form submission.

In order to perform this analysis, reCAPTCHA collects and transmits to Google the following data: IP address of the device, information about the browser and operating system (user-agent), the referring URL, the time spent on the page, cursor movements and interaction events, and cookies previously set by Google services. This data may be used by Google for its own purposes, including improving its security products.

The legal basis for processing data through reCAPTCHA is Deeplai's legitimate interest in protecting its website and contact channels from automated abuse, within the meaning of art. 6.1.f of the GDPR. Because Google LLC is established in the United States of America, data collected by reCAPTCHA may be transferred to and processed in the United States. This transfer is carried out on the basis of Standard Contractual Clauses approved by the European Commission.

ARE MY PERSONAL DATA BEING OUTSIDE THE EUROPEAN UNION?

Deeplai transfers your personal data to a third country within the meaning of the GDPR. The third country is the United States of America. The US is a country that does not belong to the European Economic Area and does not meet such high requirements for the protection of personal data as countries belonging to the European Economic Area. The personal data transferred to US are secure. The controller entrusts their processing on the basis of a data processing agreement. The processor has been certified in the Privacy Shield Framework, approved by the decision of the European Commission.

HOW LONG WILL MY DATA BE PROCESSED?

The controller processes your data for various periods of time. It depends on the purpose of data processing and their type. We can indicate the following periods: 1. for 3 years from the day that you contacted Deeplai; 2. for 3 years from the day that you visited the website managed by Deeplai.

WHAT RIGHTS DO I HAVE IN CONNECTION WITH THE PROCESSING OF MY PERSONAL DATA?

You have the right to request for the controller access to and rectification, erasure, restriction of processing or to object to processing your personal data. You only have these rights in situations where such a request is actually justified.

DO I HAVE TO PROVIDE MY PERSONAL DATA?

You do not have to provide your personal data. If you do not want that your personal data will be subjected to analytical and statistical activities, you can use special browser plugins that prevent data collection (e.g. by providing fictitious information about your browser or your behavior). Also filling out the contact form or preparing and sending an e-mail to the controller is completely voluntary but necessary to contact the controller.

THE RIGHT TO COMPLAIN

You have the right to lodge a complaint about processing your personal data by the controller. Complaint should be submitted to the supervisory authority In Poland - which is the President of the Personal Data Protection Office.

III. STORING INFORMATION IN THE USER'S FINAL TELECOMMUNICATION DEVICE

Deeplai's websites do not automatically collect any information, except for information contained in so-called cookies. Deeplai uses the so-called permanent and session cookies. Session cookies are stored on the endusers' device until they leave the website or turn off the browser. Permanent cookies are stored on the endusers' device for the time specified in their parameters. It can be the time of the browsing session, the time specified in advance or the time until their removal by the user.

In accordance with the provisions of Polish law, we assume that each user may express or refuse consent to the use of cookies through the appropriate configuration of his browser.
